Welcome to Kinesis Labs. These Terms and Conditions (“Terms”) govern your use of our website, courses, bootcamps, and services (collectively referred to as the “Services”) operated by Kinesis Labs (“we,” “us,” or “our”).

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Services.

2. Registration and User Accounts

2.1 Account Creation

To access certain features of our Services, including enrolling in bootcamps and courses, you may be required to register and create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or mobile device. You agree to accept responsibility for all activities that occur under your account or password.

3. Course Enrolment and Participation

3.1 Eligibility

Our bootcamps and courses have specific eligibility requirements and prerequisites as detailed in the respective course descriptions. By enrolling, you confirm that you meet these requirements.

3.2 Attendance and Participation

By enrolling in a bootcamp or course, you commit to attending the scheduled sessions and actively participating in the learning process. Consistent attendance is required to receive completion certificates and other benefits.

3.3 Limited Availability

Our bootcamps and courses have limited spots available. Enrolment is on a first-come, first-served basis, and completion of the application form does not guarantee admission.

4. Intellectual Property

4.1 Our Content

The content, features, and functionality of our Services, including but not limited to text, graphics, logos, images, videos, course materials, software, and code, are owned by Kinesis Labs and are protected by copyright, trademark, and other intellectual property laws.

4.2 Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services and the content, materials, and features therein solely for your personal, non-commercial use and in accordance with these Terms.

4.3 Restrictions

You may not:

• Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services without our express written consent
• Use any content from our Services for commercial purposes
• Transfer the materials to another person or “mirror” the materials on any other server
• Use our Services in any way that violates any applicable law or regulation

4.4 User Contributions

Any content you contribute during bootcamps or courses, including but not limited to projects, code, and presentations, remains your intellectual property. However, by sharing such content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content in connection with our Services and marketing.

5. Fees and Payment

5.1 Course Fees

The fees for our bootcamps and courses are as specified on our website or in the course application materials. All fees are in Indian Rupees unless otherwise stated.

5.2 Payment Terms

Payment must be made in accordance with the payment schedule provided during the enrolment process. We accept payment through the payment methods specified on our website.

5.3 Scholarships

Limited scholarships may be available for eligible candidates. The application process and eligibility criteria for scholarships are detailed on our website or available upon request.

6. Cancellation and Refunds

Please refer to our separate Refund Policy for detailed information regarding cancellations, refunds, and course transfers.

7. Code of Conduct

7.1 Community Guidelines

Participants in our bootcamps and courses are expected to:

• Treat all individuals with respect and dignity
• Contribute to a positive and inclusive learning environment
• Refrain from discriminatory, harassing, or disruptive behaviour
• Adhere to academic integrity principles, including proper attribution of work and avoiding plagiarism

7.2 Enforcement

We reserve the right to remove any participant from a bootcamp or course, temporarily or permanently, for violations of our code of conduct. No refund will be provided in cases of removal due to code of conduct violations.

8. Limitation of Liability

8.1 Disclaimer of Warranties

Our Services are provided on an “as is” and “as available” basis. Kinesis Labs makes no warranties, expressed or implied, regarding the operation or availability of the Services.

8.2 Limitation of Liability

To the maximum extent permitted by law, Kinesis Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use the Services.

9. Indemnification

You agree to defend, indemnify, and hold harmless Kinesis Labs, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Services.

Our Services may contain links to third-party websites, services, or content that are not owned or controlled by Kinesis Labs. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Your continued use of the Services after the effective date of the modified Terms constitutes your acceptance of the modified Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be exclusively brought in the courts located in Bangalore, Karnataka, India.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
